Application

These General Terms and Conditions apply to all offers, agreements, orders on the webshop and invoices from Brouwerij Eylenbosch, unless otherwise agreed in writing by both parties. By visiting our website, placing an order or using our services, the customer agrees to these general terms and conditions.

Offers

All offers made by Brouwerij Eylenbosch will be as complete as possible. The prices indicated in an offer are valid for the specified duration. Acceptance of the offer must be confirmed in writing and is therefore binding.

Orders

All orders are subject to availability of the products provided. Brouwerij Eylenbosch maintains the right to refuse or cancel orders for any reason. In the event of cancellation payment will be fully reimbursed.

Payments

The customer agrees to pay for all deliveries. The payment of any invoiced amount, tax included, needs to be done immediately, no later than 2 calendar days after the invoice date, into the bank account of Brouwerij Eylenbosch. In case of non-payment on the due date, the invoice amount will automatically and without notice be increased with a fixed compensation of 10% and with the legal interest increased with 2% on an annual basis from the due date. Brouwerij Eylenbosch will also be entitled to suspend all further deliveries to the customer in case of non-payment, without prior notice. Brouwerij Eylenbosch has the right to sell the goods to third parties. Previously paid advances will hereafter no longer be recoverable by the customer.

Payments for orders on our webshop must be made according to the payment methods indicated on our website. Prices are subject to change and any taxes or charges will be added at the time of payment.

Shipment and delivery

Brouwerij Eylenbosch strives to process and ship orders in a timely manner. Expected delivery times are mentioned on our website and are indicative. Brouwerij Eylenbosch is not liable for delays beyond its control. Brouwerij Eylenbosch is also not liable for the delivery of damaged or incomplete products if a transport company is used.

Product information

Brouwerij Eylenbosch does its best to provide accurate information about its products, including ingredients, allergens and alcohol percentages. However, the use of our products is at your own responsibility and Brouwerij Eylenbosch is not liable for any incorrect information leading to damage or inconvenience.

Intellectual property

All content on our website, including but not limited to texts, images, logos and designs, are owned or licensed by Brouwerij Eylenbosch. It is not permitted to reproduce, distribute or use this content in any way without the explicit permission of Brouwerij Eylenbosch.

Liability

Subject to legal obligations, Brouwerij Eylenbosch shall not be liable for any direct, indirect, incidental, special or consequential damages arising from the use of our products or services.

Customs and excise duties

When the customer orders products for international delivery in countries other than Belgium, the customer is the country’s importer and must comply with all laws and regulations of the country where the customer receives the goods. The customer may be subject to import duties and taxes charged once the goods enter that country. Any additional costs for customs clearance must be borne by the customer. Brouwerij Eylenbosch has no control over these costs and cannot predict what they will be. Customs policies vary greatly from country to country, so customers should contact their local customs office for more information.

Return policy

For all products purchased from Brouwerij Eylenbosch, according to the Belgian law on trade practices, information and consumer protection of 6 April 2010, you have a cooling-off period of 14 calendar days. This period starts from the moment of receipt by or on behalf of the customer. During the cooling-off period, the products and packaging must be handled with care. There is no right of withdrawal if the product and packaging are no longer in their original, complete, undamaged and unused condition.

If the customer wishes to exercise the right of return, this must be notified in writing within the stipulated 14 calendar days from the day following the delivery of the product. There is no penalty attached to renouncing the purchase and this can be done without stating a reason. If the customer wishes to return the goods, this must be confirmed by e-mail to info@eylenboschbeer.be together with the order number.

The goods must be returned undamaged, unused and unopened (in original condition and packaging) no later than 14 days after receipt. The shipping date serves as a check. All enclosed documentation, warranty certificates and packaging materials must be enclosed with the return shipment, as well as the customer’s bank account number. Direct costs for returns shall be borne by the customer. Unstamped or insufficiently stamped shipments will always be refused and returned to sender. Brouwerij Eylenbosch will refund the full purchase price within 30 days after receipt of the goods.

If it appears that the goods were not received in accordance with the conditions of the right of return, the purchase amount will not be refunded, or not in full. In this case, the product remains the property of the customer. At the customer’s request, the product can also be reshipped to the customer, subject to payment of the corresponding shipping costs.

Exceptions to the stipulated conditions are as follows:

  • For perishable goods whose packaging has been opened.
  • If a product is visibly worn or otherwise damaged, your right to a refund of your payment is invalid.

Contestation of invoices

In case of any disagreement or dispute regarding an invoice, the customer should contact us within a reasonable time after receipt of the invoice to discuss and resolve the matter.

Changes in the general Terms and Conditions

Brouwerij Eylenbosch reserves the right to amend these terms and conditions at any time. It is the customer’s responsibility to regularly check the terms and conditions for changes.
